When you’re researching a criminal defense attorney online, you’ll find plenty of information about why you should choose an attorney—but how do you know what’s actually important? An Attorney Who Touts a Large Number of Wins

“How many cases have you won?” is not always the best question to ask a criminal defense attorney. Instead, you should look for information about the types of cases your prospective attorneys have taken on and whether or not they typically avoid cases that are “hard to win.”

A winning record is a plus, but it doesn’t tell you as much as you might think it does. How many trial cases have they taken on vs. what most lawyers would consider a “layup” case? What do they consider a “win?” Do they consider a negotiated plea agreement a win in a criminal case? What about a sentence that’s below a minimum mandatory, but still a significant punishment for the crime in question?

A selective attorney who will not try your case because they don’t think they can “win” may not necessarily be right for your case. You want an attorney who has significant trial experience and is fearless in the courtroom.

Attorneys Who You Recognize From Aggressive Advertising

Your case deserves personal attention. There’s a secret in the legal industry that’s important to know: Large law firms that are aggressively advertising on billboards, park benches, buses, the radio, television, etc. often have large caseloads. Because of this, the attorney you’re actually hiring may not be the  one who actually handles your case. Your criminal defense attorney should give you the personal attention and responsiveness you require. It’s okay for office staff to handle day-to-day communication and updates, but find out o at the beginning exactly who will be handling your case. 

It’s normal for an attorney to be busy. The practice of law is very demanding and doesn’t stop for anyone, but you don’t want an attorney who can’t give you the time of day or passes you off to an associate that you’ve never met. This doesn’t mean you won’t receive effective representation, but it will affect your comfort level and satisfaction with the process.
