- Probable cause and administrative complaint. If the agency finds probable cause, it may file a formal administrative complaint setting out the allegations.
- Election of rights and hearing. You choose how to proceed. Disputed cases for most DBPR- and DOH-regulated professions are heard as formal hearings through the Division of Administrative Hearings (DOAH) before an administrative law judge; attorney discipline follows the Florida Bar’s separate grievance and referee process.
- Many matters resolve through settlement or consent agreements before hearing. Where discipline is imposed, there may be grounds for appeal.
